Terms of Service

1. Agreement
These Terms govern your use of SthirWA at chat.sthirapp.com ("Service"), operated by Aadinath Ventures (SthirApp). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
2. Service description
SthirWA provides WhatsApp Business API tooling including embedded signup, team inbox, template management, campaigns, chatbots, REST API, and webhooks. The Service integrates with Meta's WhatsApp Cloud API; availability depends on Meta and your WABA status. WhatsApp conversation charges are billed by Meta directly on your Business account.
3. Eligibility & accounts
You must be at least 18 years old and authorised to bind your organisation. You are responsible for accurate registration details, safeguarding credentials and API keys, and all activity under your account.
4. Acceptable use
You agree not to:
- Send spam, unlawful, harassing, or deceptive messages
- Violate WhatsApp Business, Commerce, or Meta platform policies
- Message contacts without valid consent or a lawful basis
- Attempt unauthorised access, reverse engineering, or service abuse
- Use the Service for malware, fraud, or regulated activity without required licences
We may suspend or terminate accounts that breach these Terms or Meta/WhatsApp requirements.
5. WhatsApp & Meta
Your use of WhatsApp messaging is also subject to Meta's terms, policies, and pricing. SthirWA is not responsible for Meta outages, template rejections, number quality rating actions, or policy enforcement by Meta.
6. Billing & subscription
Paid plans include a monthly SaaS platform fee. WhatsApp conversation costs are billed by Meta on your WhatsApp Business account — not by SthirWA. Platform fees are non-refundable except where required by law or stated in writing. We may change pricing with reasonable notice.
7. Data & privacy
You are the Data Fiduciary for end-customer data you process through the Service. You must provide appropriate privacy notices to your contacts and honour their rights. Our processing of personal data is described in the Privacy Policy.
8. Intellectual property
SthirWA software, branding, and documentation remain our property. We grant you a limited, non-exclusive licence to use the Service for your internal business purposes during an active subscription.
9. Disclaimers & liability
The Service is provided "as is" without warranties of uninterrupted or error-free operation. To the maximum extent permitted by law, our total liability is limited to fees paid by you in the twelve months before the claim.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach, non-payment, or legal requirement. Provisions that should survive (fees owed, liability limits, governing law) remain in effect.
11. Governing law
These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of courts in India, after good-faith negotiation.
